The reason the door had been propped open with the box was because the rubber door stop had worn out and could no longer hold the door open.

After the company had been investigated for the incident it had been found that over their 125 stores they didn’t have:

  • a corporate safety officer
  • a corporate safety committee, and
  • safety training for the personnel of the Philadelphia store

As a result of the accident that happened and the clear lack of safety initiative; the company was fined $834,703.

Key points that can be taken away even for Australians; considering America has extremely different laws and regulations are:

  • If you don’t have safety systems in place and you think its fine, if an accident occurs you will be caught out and the overall penalty will now take into consideration the lack of safety systems; not just the accident.
  • If something around your company needs fixing, maintaining, replacing or upgrading; don’t hold off. This could cause an accident and then it will be too late.
